Please read carefully. The Dispute Resolution section requires disputes to be resolved by binding individual arbitration and waives the right to a jury trial and to participate in a class action. The Limitation of Liability section caps our liability and limits the time you have to bring a claim.

1. Who we are

This website, honeypeakgelatin.com (the “Site”), is owned and operated by Honey Peak Nutrition LLC, PO Box 12730, Ogden, UT 84412, United States (“Honey Peak,” “we,” “us,” or “our”). We produce and supply Honey Peak Gelatin, a dietary honey gummy sold in jars of 30 gummies.

Orders placed through the Site are sold to you by PagAmerican LLC (“PagAmerican”), which acts as the Merchant of Record for each transaction. See Section 4.

By accessing the Site, browsing its pages, or placing an Order, you acknowledge that you have read, understood, and agreed to be bound by these Terms, to the maximum extent permitted by applicable law. If you do not agree with any part of these Terms, please do not use the Site and do not place an Order.

These Terms apply to the Site and to the relationship between you and Honey Peak. The purchase itself is additionally governed by the terms of PagAmerican as Merchant of Record. Where the PagAmerican terms and these Terms conflict in relation to the sale, payment, delivery, or refund of an Order, the PagAmerican terms prevail for that transaction.

4. Merchant of Record

When you complete an Order on the Site, PagAmerican purchases the Product from Honey Peak and resells it to you under its own terms and conditions. In practice this means that PagAmerican:

Honey Peak remains responsible for the quality, safety, labeling and regulatory compliance of the Product itself. The descriptor on your card or bank statement will reference PagAmerican rather than Honey Peak.

5. Eligibility

The Site and the Product are intended for adults aged 18 or older who are able to form a binding contract. By placing an Order you represent that you are at least 18 years old, that the information you provide is accurate and complete, and that you are authorized to use the payment method you submit.

We currently sell and ship only to addresses within the United States. We do not accept Orders placed for commercial resale or export.

6. Product and health notice

Honey Peak Gelatin is a dietary product intended for adults, not a medicine. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Nothing on the Site is medical advice, and no content on the Site should be used as a substitute for consultation with a qualified healthcare professional. Do not exceed the recommended dose printed on the label. Pregnant or nursing mothers, children under the age of 18, and individuals with a known medical condition should consult a physician before using this or any dietary product. Keep out of reach of children. Do not use if the safety seal is damaged or missing.

Individual experiences vary, and no specific result is promised or guaranteed. If you experience an adverse reaction, stop using the Product and seek medical attention. You may also report the reaction to us at support@honeypeakgelatin.com.

You are responsible for reading the ingredient list before ordering. The full facts panel and ingredient list are reproduced in the Label section of the Site and printed on every jar.

7. Orders and acceptance

Submitting an Order at checkout is an offer to buy the Product on these Terms. The Order is reviewed and may be accepted or declined for any lawful reason, including product availability, pricing or typographical errors, fraud and risk checks, quantity limits, or an incomplete or unverifiable shipping address.

If the Order is accepted, you will receive an order confirmation email with your order number and product details. The contract is formed when that email is sent. If the Order cannot be accepted or must be cancelled, you will be informed and you will not be charged; if a charge was already processed, it will be refunded.

It is your responsibility to supply a valid email address and accurate billing and shipping details so that the Order can be confirmed and delivered.

8. Prices, taxes and errors

All prices are quoted in United States dollars (USD). The price that applies to your Order is the price displayed at checkout at the moment you place it. Prices and availability may change at any time, and price changes apply only to future Orders.

Applicable transaction taxes are calculated, collected and remitted by PagAmerican and are shown at checkout before you pay. Taxes imposed specifically on you as the buyer, if any, are your responsibility.

If a pricing, stock or typographical error is identified, we or PagAmerican may correct it and cancel any Order arising from the error, without liability beyond refunding any amount already charged.

9. Payments

To complete a purchase you must provide valid and accurate payment details and confirm that you are authorized to use the payment method chosen. Payment must be authorized by your card issuer or payment provider and accepted by PagAmerican. Payment is captured when the Order is processed.

A payment may be cancelled or blocked, or future payments prevented, where: these Terms or applicable law are breached; the payment method is declined; fraud or unlawful activity is suspected; the account shows excessive disputes or reversals; or you decline to cooperate with a reasonable identity or payment verification request.

Every offer presented on the Site is a one-time purchase for the quantity shown, and the payment method is charged once, at the time the Order is processed.

10. Delivery

Orders ship within 1–2 business days of acceptance, and delivery within the United States typically takes 3–7 business days after dispatch. Tracking information is emailed once the Order leaves the facility. Shipping within the United States is included in the prices displayed on the Site.

Delivery timelines are estimates and are not guaranteed. Delivery deadlines may be extended, or shipment refused, for reasons including availability, risk checks or error. Neither Honey Peak nor PagAmerican is liable for delays caused by carriers, weather, customs, incorrect addresses supplied by you, or other events outside reasonable control.

Title and risk of loss pass to you when the Product is shipped and becomes available to you in your country of residence. If your delivery arrives damaged or incomplete, contact support within 7 calendar days of delivery so the Order can be resolved.

11. Cancellations, returns and refunds

Order cancellations are governed by the Cancellation Policy. Returns, refunds and delivery issues are governed by the Purchase Policies. Because PagAmerican is the Merchant of Record, any refund is issued by PagAmerican, to the original payment method.

12. Acceptable use

You agree to use the Site lawfully and not to: scrape, copy, mirror or frame the Site; bypass or probe security measures; reverse-engineer any part of the Site; introduce malware or automated traffic; impersonate another person; collect personal data of other users; or use the Site in a way that interferes with its operation. We may investigate suspected violations, restrict access, and cooperate with authorities where required by law.

13. Intellectual property

The Site and its content — including the Honey Peak and Honey Peak Gelatin names, logos, label artwork, product photography, layout, copy and code — are owned by Honey Peak Nutrition LLC or licensed to it, and are protected by United States and international intellectual property laws. Using the Site or purchasing the Product does not transfer any ownership or license to you beyond the right to use the Product you bought.

You may not reproduce, distribute, modify or create derivative works from Site content, or use our marks, without prior written permission.

Reporting infringement. If you believe material on the Site infringes your copyright, send a notice to support@honeypeakgelatin.com including: (a) identification of the copyrighted work; (b) the URL or description needed to locate the material; (c) your contact information; (d) a statement that the use is not authorized by the copyright owner, its agent or the law; (e) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act; and (f) your physical or electronic signature.

14. Feedback

If you send us ideas, suggestions or comments about the Product or the Site (“Feedback”), you grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, copy, modify, publish and create derivative works from that Feedback, without compensation or attribution. Feedback is treated as non-confidential; do not send information you do not have the right to share. We may already be developing similar ideas and have no obligation to use or respond to Feedback.

15. Third-party links and services

The Site links to services operated by third parties, including the PagAmerican checkout. We do not control those services and are not responsible for their content, policies or practices. Your use of them is at your own risk and subject to their own terms.

16. Privacy

Personal data collected through the Site is processed as described in our Privacy Policy. By using the Site you consent to that processing. Payment data submitted at checkout is processed by PagAmerican under its own privacy policy; we never receive or store full card numbers.

17. Disclaimers

The Site and the Product are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, quiet enjoyment and non-infringement, and we do not warrant that the Site will be uninterrupted, secure, error-free or that its content is complete or current.

We make no representation that the Product is appropriate for any particular person or circumstance. See Section 6.

18. Limitation of liability

To the extent permitted by law, neither Honey Peak Nutrition LLC nor its officers, employees, suppliers or service providers will be liable for any indirect, incidental, special, exemplary, punitive or consequential damages — including lost profits, revenue, savings, data, goodwill or business opportunity, or the cost of substitute products — arising out of or relating to the Site or the Product, under any legal theory, even if advised of the possibility of such damages and even if a limited remedy is found to have failed its essential purpose.

Our total aggregate liability is capped at the greater of (a) the amount you paid for the Order giving rise to the claim during the 12 months before the event, or (b) USD $100.

Any claim arising out of or relating to these Terms or the Site must be brought within one (1) year after the claim arises, or it is permanently barred, except where a longer period is required by applicable law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence.

19. Indemnification

You agree to indemnify and hold harmless Honey Peak Nutrition LLC and its officers, employees and agents from any claim, demand, loss, liability or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, your violation of any law, or your infringement of any third-party right.

20. Changes to these Terms

We may amend these Terms at any time. The current version is always posted on this page with its effective date. Continued use of the Site after a change takes effect means you accept the revised Terms. Material changes may also be notified by email to the address on file; email notices are effective when sent, and posted notices when posted. The version in force for a given Order is the version published on the date the Order was placed.

21. Dispute resolution and arbitration

Mandatory individual arbitration

Any dispute or claim arising out of or relating to these Terms, the Site or the Product will be resolved exclusively by binding, individual arbitration. You and we waive the right to a jury trial and the right to participate in a class action. The Federal Arbitration Act governs the enforcement of this agreement to arbitrate.

Exceptions

Either party may (i) bring a qualifying claim in small-claims court, and (ii) seek injunctive or other equitable relief in court to prevent or stop infringement or misuse of intellectual property rights.

Rules and process

The arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this section; the rules are published at adr.org. Hearings take place in the county or parish where you live, unless both parties agree otherwise. The arbitrator has exclusive authority to decide questions about the interpretation, applicability, enforceability and scope of this arbitration agreement. The arbitrator may award relief only to the individual party in the case and may not award class-wide or public injunctive relief; where public injunctive relief is sought, a court decides that question and any such court proceeding is stayed until the individual arbitration concludes.

Costs

Filing, administration and arbitrator fees are handled under the AAA Rules. We will not seek to recover the administration and arbitrator fees for which we are responsible unless the arbitrator finds your claim frivolous. If we prevail, we bear our own attorneys' fees and costs; if you prevail, you may recover attorneys' fees and expenses to the extent provided by law.

Class action waiver

Claims may be brought only in an individual capacity, not as a plaintiff or class member in any class, representative or consolidated proceeding, and the arbitrator may not consolidate the claims of more than one person. If this class action waiver is found unenforceable, this entire Section 21 is null and void.

22. Governing law

These Terms and any transaction processed through the Site are governed by the laws of the United States of America and the State of Delaware, without regard to conflict of law principles. For disputes not subject to arbitration, the exclusive forum is the state and federal courts located in Delaware, and both parties waive objections to jurisdiction and venue there.

23. Termination

These Terms take effect as soon as you access the Site or place an Order, and end automatically if you stop using the Site or fail to comply with them. We may suspend or end your access to the Site, or cancel an Order, at any time and without notice, where we believe it necessary to address non-compliance, misuse or risk.

Sections that by their nature should survive termination do survive, including those on payments owed, intellectual property, feedback, disclaimers, limitation of liability, indemnification, dispute resolution and governing law.

24. Miscellaneous

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms freely, including in connection with a merger or sale of assets.

Waiver. A waiver is effective only if given in writing and signed by an authorized representative of Honey Peak Nutrition LLC. Failure to enforce any provision is not a waiver of the right to enforce it later.

Severability. If any provision is held illegal, invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will stay in full force and effect.

Entire agreement. These Terms, together with the Purchase Policies, the Cancellation Policy and the Privacy Policy, constitute the entire agreement between you and us regarding the Site, and supersede any prior understanding on the subject.

Force majeure. Neither party is liable for failure or delay caused by events beyond reasonable control, including natural disasters, labor disputes, carrier failures, utility or network outages, or acts of government.
